J: McCain is a Stupid Jerk

I have a much more offensive post at my regular blog, but I thought this FEC business deserved a spot here. The chairman, Brad Smith, certainly doesn't sound like he even wants to do this, but he's hinting nonetheless that substantial restrictions are on our way.

For what seems like the 100th time, this represents yet another opportunity for Justice Scalia to claim "I told you so."

I'm particularly looking forward to the day when Scalia gets to say "I told you so" about how overruling Bowers would lead us to permit bigamy and bestiality.

What do you think of Justice Thomas's apparent advocacy (in his McConnell opinion) of a broader anti-bribery law to combat corruption, fear of which is the reason the majority of people supported BCRA?

Well, it could get too broad - ie, "I'll give you $X in the hopes you do everything you can to lower taxes" probably shouldn't be illegal without raising the same concerns with the BCRA. So I'm hesitant. But Thomas is no legislator anyways, so I can't fault him too much for not thinking up a great law.

Didn't the slippery slope provide Scalia with access to Dick Cheney's duck blind a year or so ago? What with Dick and his boss as lame ducks, and Scalia's slipping on federalism, it looks like a Thomas promise for C.J. if Rehnquist decides to retire.
